Site Before Night Website Service Agreement

This agreement explains how the Site Before Night request, authorization, Build Day, review, approval, payment, launch, hosting, support, and cancellation process works.

After the website is accepted and the $499 build fee is captured, the customer completes recurring hosting enrollment before the website is launched on its production domain.

Website Service Terms

By electronically accepting these terms, authorizing the initial website build, completing recurring service enrollment, or otherwise instructing Site Before Night to proceed, the customer agrees to this Website Service Agreement.

1. Business Days and Business Hours

For purposes of this agreement, a Site Before Night business day is Monday through Friday, excluding holidays observed by Site Before Night. Standard business-day hours are 8:00 AM through 8:00 PM Eastern Time.

An authorization successfully completed before 8:00 PM Eastern Time on a business day is treated as received that business day. An authorization completed after 8:00 PM, on a weekend, or on an observed holiday is treated as received on the next business day.

When this agreement refers to a period measured in literal hours, including the 48-hour website review period, that period runs continuously and is not limited to business hours or business days.

2. Website Request Review and Project Acceptance

Submission of a website request does not obligate Site Before Night to accept the project and does not reserve a Build Day.

Site Before Night reviews each request to determine whether the project fits the streamlined Site Before Night service model. Requests received during a normal business day are generally reviewed for approval or rejection the same business day when reasonably possible, but same-day review is not guaranteed.

If a request is approved, the customer will receive instructions for completing the initial $499 website-build authorization.

3. Initial $499 Payment Authorization

The standard initial website-build price is $499.

Before Build Day, the customer authorizes Site Before Night and its payment processor to place an authorization hold for up to $499 on the customer's approved payment method. The authorization reserves the funds but is not the same as a completed or captured payment.

Site Before Night does not ordinarily capture the $499 build fee before the customer has received the staged website and had the opportunity to exercise the review rights described in this agreement.

An authorization hold is not a completed charge. If the customer properly rejects the website during the applicable 48-hour review period, Site Before Night will cancel or release the uncaptured authorization rather than collect the $499 build fee.

The customer's bank or card issuer controls how quickly a released authorization disappears from the customer's available-balance or pending-transaction display.

4. Build Day and Before Night Delivery

When the $499 authorization is successfully completed before 8:00 PM Eastern Time on a business day, the next business day will ordinarily become the customer's Build Day.

If authorization is completed after the applicable cutoff, on a weekend, or on an observed holiday, it will be treated as received on the next business day, and Build Day will ordinarily be the following business day.

Build Day runs from 8:00 AM through 8:00 PM Eastern Time. Site Before Night may work on the project throughout that window, and the staged website may be delivered closer to the end of the Build Day.

For a qualifying project, Site Before Night's Before Night commitment is to provide the customer with access to the staged initial website by 8:00 PM on the scheduled Build Day.

If Site Before Night is unable to provide the qualifying staged website by the applicable deadline for reasons within Site Before Night's reasonable control, Site Before Night may release the $499 authorization and waive the initial build charge.

The delivery commitment does not apply to delays caused by missing customer information, customer-requested scope changes, inaccessible third-party accounts, domain problems, platform or network outages, extraordinary events, or other circumstances beyond Site Before Night’s reasonable control.

5. Staged Delivery and 48-Hour Review Period

When the initial website is ready for review, Site Before Night will send the customer a delivery email containing a staged website address or other appropriate preview link.

The customer's 48-hour review period begins at the time that delivery email is sent. The review period consists of 48 consecutive literal hours, including nights, weekends, and holidays.

During the review period, the customer may approve the website, request reasonable light modifications within the original service scope, or reject the initial website.

Customers are responsible for reviewing the staged website promptly. Waiting until the end of the review period to submit questions or requested changes does not extend the original review deadline.

6. Modifications During the Review Period

Site Before Night will consider reasonable light corrections or modifications submitted during the 48-hour review period when those requests remain within the agreed initial website scope.

A modification request does not pause, restart, renew, or create a new 48-hour review period. The original review period continues to run from the time the initial staged website delivery email was sent.

Customers therefore agree to remain reasonably available and respond promptly when modifications are requested or completed.

Site Before Night may expressly extend a review deadline in writing when circumstances justify doing so, but no extension should be assumed unless Site Before Night specifically confirms it.

Significant redesigns, expanded scope, extensive additional data entry, new functionality, or other requests beyond the original project may require a separate quote and are not included as light review-period modifications.

7. Website Acceptance and Capture of the $499 Build Fee

If the customer affirmatively approves the staged website during the review period, the customer authorizes Site Before Night to capture the $499 build fee immediately or as soon thereafter as reasonably practical.

If the customer does not submit an approval, modification request, or rejection before expiration of the 48-hour review period, the customer agrees that the website will be deemed accepted at the end of that review period.

Upon deemed acceptance, Site Before Night is authorized to capture the $499 build fee at the expiration of the review period or as close thereafter as reasonably practical.

By proceeding with the project, the customer specifically agrees in advance that expiration of the 48-hour review period without a timely rejection constitutes acceptance of the initial website and authorization to capture the $499 build fee.

8. Rejection During the Review Period

If the customer timely rejects the staged website before expiration of the 48-hour review period, Site Before Night will cancel the project and release or cancel the uncaptured $499 authorization.

Because the authorized funds have not yet been captured, release of the authorization is not a refund. No initial website-build fee will have been collected.

Following a timely rejection, Site Before Night is not required to transfer, publish, release, provide access to, or continue work on the rejected staged website.

9. Recurring Service Enrollment and Website Launch

Acceptance and capture of the $499 build fee complete the initial website-build transaction but do not by themselves complete the production launch process.

Before the accepted website is connected to its production domain and launched, the customer must complete enrollment in the Site Before Night managed hosting and technical-support service at the then-applicable recurring rate, which is currently $49 per month unless otherwise agreed in writing.

The first $49 recurring charge will normally be scheduled for approximately 30 days after the date on which the customer accepts the website and the $499 initial build fee is captured. Subsequent recurring charges will normally occur monthly thereafter.

After the initial fee has been captured and recurring service enrollment has been completed, Site Before Night will proceed with the normal domain-connection and production-launch process.

Site Before Night will also provide the customer with applicable website login credentials and helpful information for making ordinary website updates, generally as soon as reasonably practical and normally within one business day after the required launch conditions have been completed.

If the customer accepts the website but fails to complete required recurring-service enrollment, Site Before Night may withhold production launch and customer administrative access until the enrollment requirement is completed. The already captured $499 initial build fee remains subject to the no-refund provision below.

10. Final Payments and No-Refund Policy

Once the $499 initial website-build fee has been captured following affirmative or deemed acceptance of the website, the build fee is final and nonrefundable.

Site Before Night commits labor, production resources, platform resources, contractor or team-member compensation, and other business costs in fulfilling website projects. For that reason, captured website-build fees are not refundable simply because the customer later changes plans, closes a business, changes providers, decides not to launch, or no longer wishes to use the website.

Recurring monthly hosting and technical-support charges are likewise final and nonrefundable once processed.

This no-refund policy does not limit any right or remedy that applicable law does not permit the customer to waive.

11. Managed Hosting and Technical Support

The standard recurring service is currently $49 per month and includes managed hosting and reasonable technical support within the Site Before Night service scope.

The recurring service is not an unlimited content-editing, website-management, marketing, design, or development retainer.

Work such as extensive new content entry, significant redesign, custom development, advanced integrations, advanced search-engine optimization, advertising management, custom analytics configuration, substantial new page creation, or other services outside ordinary hosting and technical support may require additional fees.

Customers may use available customer-facing editing tools to make ordinary changes to permitted website content.

12. Month-to-Month Service and Cancellation

The managed hosting and technical-support service is month-to-month. The customer is not required to remain with Site Before Night for a fixed long-term contract period.

Customers agree to provide at least 30 days' written notice when they wish to cancel recurring website service.

To avoid an additional scheduled monthly charge, cancellation notice should be received at least 30 days before the customer's next applicable billing date. A monthly charge that has already been processed is final and nonrefundable.

Service will continue during any applicable paid service period unless Site Before Night and the customer agree otherwise in writing.

When managed hosting ends, the Site Before Night website may be removed from public availability and the customer's access to platform-based editing or management tools may end.

13. Customer Responsibilities

The customer agrees to provide accurate and reasonably complete information needed to build and launch the website, including appropriate business information, contact details, branding, primary services or products, domain information, and other materials reasonably requested by Site Before Night.

The customer is responsible for reviewing the staged website for factual accuracy during the review period.

The customer represents that the customer has the legal right to provide and authorize use of any photographs, logos, trademarks, written material, documents, graphics, or other materials submitted for the website.

Customers should not send passwords through ordinary intake forms or unsecured email unless specifically instructed to use an approved secure process.

14. Initial Website Scope and Customer Materials

Site Before Night provides a professionally prepared initial small-business website using a proven website framework and information supplied by the customer.

Site Before Night may select, summarize, organize, resize, format, rewrite, or otherwise prepare supplied information and materials as reasonably appropriate for the initial website.

Site Before Night provides an initial professional website, not unlimited custom design or unlimited data entry.

Uploading or submitting a menu, catalog, service list, price sheet, brochure, photo collection, document, or other material does not obligate Site Before Night to manually reproduce every item, price, service, product, image, paragraph, or detail contained in those materials.

Site Before Night may use representative content, organize information into broader categories, feature selected materials, or link to or display an appropriate supplied document rather than manually recreating all of its contents.

After launch, customers may continue expanding and editing ordinary website content within the permissions available through the customer editing system.

15. Domain Names, Account Access, and Third-Party Services

Site Before Night includes normal assistance with connecting the accepted website to the customer's production domain.

The customer may be required to authorize changes, provide appropriate account access through an approved process, or cooperate with instructions necessary to complete the domain connection.

Domain ownership disputes, expired domains, inaccessible registrar accounts, account-recovery issues, unusual DNS configurations, email-system changes, third-party integrations, or similar matters outside the normal launch process may require additional work or separate fees.

Websites may use or interact with third-party systems such as domain registrars, Google products, social platforms, analytics providers, maps, forms, scheduling services, payment processors, or other external services.

Site Before Night does not control third-party pricing, policies, interfaces, uptime, features, account requirements, or future changes.

16. Search Engines, Analytics, Leads, and Marketing Results

Site Before Night prepares websites using sound basic website practices, but the standard Site Before Night service is not an ongoing SEO campaign, advertising program, lead-generation guarantee, social-media-management service, or digital-marketing contract.

Site Before Night does not guarantee Google rankings, search-engine placement, website traffic, form submissions, telephone calls, leads, revenue, sales, or any specific business outcome.

Advanced SEO, advertising, analytics configuration, content marketing, custom integrations, and other marketing services may be offered or quoted separately.

17. Customer Content, Platform Ownership, and Website Portability

The customer retains ownership of original logos, trademarks, photographs, written materials, and other original business content supplied by the customer, subject to any rights belonging to third parties.

Site Before Night operates websites through a managed, proprietary or licensed website software and hosting environment. The underlying platform, software, system code, templates, framework components, editing tools, licensed design elements, and related technology remain the property of their respective owners and are not sold or transferred to the customer as independent software or source files.

A Site Before Night website is not designed as a portable package of website files that can simply be downloaded and transferred intact to another hosting company or website platform.

If the customer later chooses another website provider or platform, the customer's original business content may generally be reused where the customer has the right to do so, but the website itself may need to be rebuilt on the new provider's platform.

The streamlined managed-platform structure is an intentional part of the Site Before Night service model and contributes to the speed, simplicity, hosting management, technical support, and affordability of the service.

18. Acceptable Use, Service Limitations, and Agreement Acceptance

Site Before Night may refuse, suspend, or terminate service involving unlawful, fraudulent, infringing, malicious, abusive, technically harmful, or otherwise prohibited content or activity.

Website services depend on software platforms, internet networks, browsers, domain systems, payment processors, hosting infrastructure, search engines, and other technologies that may occasionally experience interruptions, changes, or failures outside Site Before Night's reasonable control.

To the maximum extent permitted by applicable law, Site Before Night and Kingdom Web Pros will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from website downtime, third-party failures, customer edits, customer-supplied content, search-engine changes, lost opportunities, or circumstances outside reasonable control.

By accepting this agreement, authorizing the initial project, approving the website, allowing the 48-hour review period to expire without rejection, completing recurring service enrollment, or otherwise instructing Site Before Night to continue, the customer acknowledges and accepts the applicable terms described above.
